    It's against the law to do so. The people can make an ad for it, someone can make the purchase or bid, but they'll never receive the phone or get the money. You can't sell something online if you haven't made it. They are basically trying to sell the app for $89,000 and receive a criminal history all at once.

    But they're selling the phone, not the app :)

    I don't know the subtleties, but that sounds fine to me...

    No, they're not. Yes, they are selling a phone, but they are also clearly making the fact that the phone has Flappy Birds on it which is where most of the price is found. Either way it's illegal and Ebay won't allow it.

    What do you know about the law...

    Are you secretly a black market experimental can opener dispenser? Are you a fugitive? Are you not allowed back to England? Is CanOpenerTrooper even your real name?

    Apologies, but could you quote your sources?

    I just did a quick google search, and the Australian (Well, Queensland anyway) government has a thing saying that it's basically fine so long as you sell it for its intended purpose.

    In much the same way, I saw nothing like this on the E-Bay user agreement.

    I think you may be getting this confused with copyright and intellectual property. Which is either me identifying as someone I'm not in order to sell products and/or copying their products instead of designing my own.

    Yeah I saw that on Ebay... Apparently their quoting their phone as 'rare' even though more than 1m own the app.

    Barely anyone reads the user agreement. Someone could put in "You are selling us your soul." and it would be a long time till someone noticed it.

    I have no idea why people do not read them. You would not sign a contract without reading it, so why agree to a digital one without doing so?

    You just scroll down and click 'agree'? I don't think I have ever read more than the first paragraph sentence of an agreement. :confused:
